1)The disparities between the laws or administrative measures adopted by the Member States as regards the restriction of the use of hazardous substances in electrical and electronic equipment could create barriers to trade and distort competition in the Community and may thereby have a direct impact on the establishment and functioning of the internal market. It therefore appears necessary to approximate the laws of the Member States in this field and to contribute to the protection of human health and the environmentally sound recovery and disposal of waste electrical and electronic equipment. 1)各成員國為了限制在電子電氣設備中使用有害物質而制訂的法規或行政措施之間所存在的差異,會產生貿易障礙和扭曲共同體內的競爭,甚至對單一市場的建立及其功能產生直接影響。因此有必要協調各成員國在這個領域中的法規,以利於保護人類健康並符合對於廢棄電子、電氣設備要求回收和處理的環境要求。
2)The European Council at its meeting in Nice on 7, 8 and 9 December 2000 endorsed the Council Resolution of 4 December 2000 on the precautionary principle. 2)歐盟理事會於2000年12月7~9日在尼斯召開的會議上,批准了部長理事會於2000年12月4日針對預防原則所通過的決議。
3)The Commission Communication of 30 July 1996 on the review of the Community strategy for waste management stresses the need to reduce the content of hazardous substances in waste and points out the potential benefits of Community-wide rules limiting the presence of such substances in products and in production processes. 3)歐盟委員會1996年7月30日回顧共同體對於廢棄物管理的策略,強調了減少廢棄物中有害物質含量的必要性,並指出制定在產品和加工過程中,限制使用這些有害物質的歐洲共同體法規的潛在益處。
4)The Council Resolution of 25 January 1988 on a Community action programme to combat environmental pollution by cadmium invites the Commission to pursue without delay the development of specific measures for such a programme. Human health also has to be protected and an overall strategy that in particular restricts the use of cadmium and stimulates research into substitutes should therefore be implemented. The Resolution stresses that the use of cadmium should be limited to cases where suitable and safer alternatives do not exist. 4)理事會於1988年1月25日為消除鎘環境污染的歐共體所決定的行動計劃,要求歐盟委員會對類似計劃中中特殊衡量標準的研發必須持續而不容延緩。人類健康也必須受到保護,因此應實施一個整體策略,以限制鎘的使用及加快研究其替代品。決議中強調:在還沒有更適當、更安全的可替代品情況下,鎘的使用應該受到限制。
5)The available evidence indicates that measures on the collection, treatment, recycling and disposal of waste electrical and electronic equipment (WEEE) as set out in Directive 2002/96/EC of 27 January 2003 of the European Parliament and of the Council on waste electrical and electronic equipment (6) are necessary to reduce the waste management problems linked to the heavy metals concerned and the flame retardants concerned. In spite of those measures, however, significant parts of WEEE will continue to be found in the current disposal routes. Even if WEEE were collected separately and submitted to recycling processes, its content of mercury, cadmium, lead, chromium VI, PBB and PBDE would be likely to pose risks to health or the environment. 5)目前的證據證明,歐盟理事會和歐洲議會2003年1月27日關於報廢電子電氣設備的第2002/96/EC號指令規定的報廢電子電氣設備的收集、處理、回收和處置措施,對於減少與涉及的重金屬和阻燃劑相關的廢物管理問題有其必要。然而,儘管有那些措施,但在目前的廢物處理中,仍會繼續發現報廢電子、電氣設備的實質部分。即使報廢電子、電氣設備被分類收集並遵守回收程序,但汞、鎘、鉛、六價鉻、聚溴聯苯(PBB)、聚溴二苯醚(PBDE)的成分,仍有可能對人類健康和環境造成危害。
6)Taking into account technical and economic feasibility, the most effective way of ensuring the significant reduction of risks to health and the environment relating to those substances which can achieve the chosen level of protection in the Community is the substitution of those substances in electrical and electronic equipment by safe or safer materials. Restricting the use of these hazardous substances is likely to enhance the possibilities and economic profitability of recycling of WEEE and decrease the negative health impact on workers in recycling plants. 6)考慮到技術和經濟的可行性,要確保顯著降低這些物質對健康和環境造成的危害,有效且在共同體內可以選擇實際執行的保護層級,就是在電子,電氣設備中,以安全或更安全的物質替代它們。限制這些有害物質的使用也就提高了廢棄電子、電氣設備回收的可能性和經濟效益,並減少它們對回收工廠工人的健康所造成的負面影響。
7)The substances covered by this Directive are scientifically well researched and evaluated and have been subject to different measures both at Community and at national level. 7)本指令中所涵蓋的物質是經過科學研究與評估過的,並且在歐共體和國際層級也受到不同評量標準的限制。
8)The measures provided for in this Directive take into account existing international guidelines and recommendations and are based on an assessment of available scientific and technical information. The measures are necessary to achieve the chosen level of protection of human and animal health and the environment, having regard to the risks which the absence of measures would be likely to create in the Community. The measures should be kept under review and, if necessary, adjusted to take account of available technical and scientific information. 8)本指令規定的措施考慮了現有的國際準則和建議,並基於對可獲得的科學和技術資訊的評估。由於缺乏措施可能在共同體內產生危險,所以這些措施對實現所選擇的對人類和動物健康及環境的保護層級是必要的。應即時檢查這些措施,必要時,考慮當時可取得的科技資訊後可進行調整。
9)This Directive should apply without prejudice to Community legislation on safety and health requirements and specific Community waste management legislation, in particular Council Directive 91/157/EEC of 18 March 1991 on batteries and accumulators containing certain dangerous substances (註7). 9)本指令的實施不影響共同體因安全和衛生需要所做的立法以及共同體有關廢棄物管理的特殊立法,特別是1991年3月18日理事會關於含有某些危險物質的電池和蓄電池的第91/157/EEC號指令。
10)The technical development of electrical and electronic equipment without heavy metals, PBDE and PBB should be taken into account. As soon as scientific evidence is available and taking into account the precautionary principle, the prohibition of other hazardous substances and their substitution by more environmentally friendly alternatives which ensure at least the same level of protection of consumers should be examined. 10)應考慮不含有重金屬、聚溴二苯醚(PBDE) 和聚溴聯苯(PBB) 的電子電氣設備的技術發展。一旦獲得了科學證據和考慮了預防原則,應檢查是否可以禁止其它有害物質的使用並可以更加合乎環境要求、並且確保替代品對消費者的保護至少應維持在相同層級。
11)Exemptions from the substitution requirement should be permitted if substitution is not possible from the scientific and technical point of view or if the negative environmental or health impacts caused by substitution are likely to outweigh the human and environmental benefits of the substitution. Substitution of the hazardous substances in electrical and electronic equipment should also be carried out in a way so as to be compatible with the health and safety of users of electrical and electronic equipment (EEE). 11)如果從科學與技術的觀點來看,不可能有替代品,或者替代品對於環境和健康所造成的負面影響大於它對環境和健康帶來的益處,那麼可以排除執行使用替代品的要求。研發電子電氣設備中有害物質替代品的工作仍然應繼續進行,以使它們符合電子電氣設備使用者的健康與安全需要。
12)As product reuse, refurbishment and extension of lifetime are beneficial, spare parts need to be available. 12)當成品的再利用、翻新和延長使用壽命有益於上述宗旨時,就必須提供所需的零件。
13)The adaptation to scientific and technical progress of the exemptions from the requirements concerning phasing out and prohibition of hazardous substances should be effected by the Commission under a committee procedure. 13)與逐步停止使用和禁止使用有害物質的要求免除相關的科技進步的修改應由歐盟委員會按照委員會程序生效。
14)The measures necessary for the implementation of this Directive should be adopted in accordance with Council Decision 1999/468/EC of 28 June 1999 laying down the procedures for the exercise of implementing powers conferred on the Commission, 14)實施本指令所需的措施必須依據理事會於1999年6月28日1999/468/EC號決議規定,施行授權給歐委會權力的程序來採納。
   
HAVE ADOPTED THIS DIRECTIVE: 茲通過本指令:
   
Article 1 第1條
Objectives 目的
The purpose of this Directive is to approximate the laws of the Member States on the restrictions of the use of hazardous substances in electrical and electronic equipment and to contribute to the protection of human health and the environmentally sound recovery and disposal of waste electrical and electronic equipment. 本指令的目的是使各成員國在有關於電子、電氣設備中限制使用有害物質的法律趨於一致,有助於保護人類健康和廢棄電子、電氣設備合乎環境要求的回收和處理。
   
Article 2 第2條
Scope 範圍
.Without prejudice to Article 6, this Directive shall apply to electrical and electronic equipment falling under the categories 1, 2, 3, 4, 5, 6, 7 and 10 set out in Annex IA to Directive No 2002/96/EC (WEEE) and to electric light bulbs, and luminaires in households. .在不違反第6條的情況下,本指令應該適用於提令第2002/96/EC號指令(WEEE )附錄IA規定的1、2、3、4、5、6、7和10類電子電氣設備,以及家用電燈泡和照明設施。
. This Directive shall apply without prejudice to Community legislation on safety and health requirements and specific Community waste management legislation. .本指令的實施不應違背共同體有關於安全和健康要求的立法,和共同體有關廢棄物管理的特殊立法。
. This Directive does not apply to spare parts for the repair, or to the reuse, of electrical and electronic equipment put on the market before 1 July 2006. 本指令不適用於2006年7月1日以前投入市場,做為電子或電氣裝置的備品零件、維修零件或再利用零件。
   
Article 3 第3條
Definitions 定義
For the purposes of this Directive, the following definitions shall apply: 就本指令目的而言,適用於以下定義:
(a)‘electrical and electronic equipment’ or ‘EEE’ means equipment which is dependent on electric currents or electromagnetic fields in order to work properly and equipment for the generation, transfer and measurement of such currents and fields falling under the categories set out in Annex IA to Directive 2002/96/EC (WEEE) and designed for use with a voltage rating not exceeding 1,000 volts for alternating current and 1,500 volts for direct current; (a)電子與電氣設備,或者簡稱為"EEE"是指:依靠電流或電磁場而正常執行工作的設備及2002/96/EC(WEEE) 指令,其附件IA中所列:能產生、傳輸和測量電流和電磁場的設備,而且這些設備的設計電壓,交流電不超過1,000 伏特,直流電不超過1,500伏特;
(b) ‘producer’ means any person who, irrespective of the selling technique used, including by means of distance communication according to Directive 97/7/EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts: (b)"生產者"意指:不論採用那一種銷售技術的任何人,包括藉由依歐洲議會和理事會1997年5月20日第97/7/EC號指令對保護遠端合約消費者進行的遠程通訊:
(i)manufactures and sells electrical and electronic equipment under his own brand; (i)用自有品牌生產並銷售電子電氣設備者;
(ii)resells under his own brand equipment produced by other suppliers, a reseller not being regarded as the ‘producer’ if the brand of the producer appears on the equipment, as provided for in subpoint (i); or (ii)由第三方供應商生產而以自有品牌再銷售的設備,如果再銷售的設備上仍保留原生產者的品牌,再銷售者不能被視為上述附則(i)定義的生產者;或
(iii) imports or exports electrical and electronic equipment on a professional basis into a Member State.
Whoever exclusively provides financing under or pursuant to any finance agreement shall not be deemed a ‘producer’ unless he also acts as a producer within the meaning of subpoints (i) to (iii).

Article 4 第4條
Prevention 預防
1.Member States shall ensure that, from 1 July 2006, new electrical and electronic equipment put on the market does not contain lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE). National measures restricting or prohibiting the use of these substances in electrical and electronic equipment which were adopted in line with Community legislation before the adoption of this Directive may be maintained until 1 July 2006. 1.成員國將確保:從2006年7月1日起,投入市場的新電子和電氣設備不得包含鉛、汞、鎘、六價鉻、聚溴二苯醚(PBDE) 或聚溴聯苯(PBB)。成員國在本指令通過前根據共同體法規制定的限制或禁止,在電子電氣設備中使用這些物質的措施,可以維持至2006年7月1日。
2.Paragraph 1 shall not apply to the applications listed in the Annex. 2.條款1將不套用於附件中所列舉的應用。
3.On the basis of a proposal from the Commission, the European Parliament and the Council shall decide, as soon as scientific evidence is available, and in accordance with the principles on chemicals policy as laid down in the Sixth Community Environment Action Programme, on the prohibition of other hazardous substances and the substitution thereof by more environment-friendly alternatives which ensure at least the same level of protection for consumers. 3.基於歐委會的建議,一旦經科學證明為可行時,歐洲議會和理事應該根據《第六個共同體環境行動計劃》中規定的化學政策原則,盡快決定對其他有害物質的禁用以及選擇確保對消費者保護等級至少相同而更符合環境需求的產品作為其替代品。
   
Article 5 第5條
Adaptation to scientific and technical progress 順應科學與技術的進步
1. Any amendments which are necessary in order to adapt the Annex to scientific and technical progress for the following purposes shall be adopted in accordance with the procedure referred to in Article 7(2): 1.為下列目的,旨在使附件適應科技進步的必要修改,應根據第7條2款所提及的程序進行:
(a)establishing, as necessary, maximum concentration values up to which the presence of the substances referred to in Article 4(1) in specific materials and components of electrical and electronic equipment shall be tolerated; (a)必要時,可以建立允許在電子電氣設備的特殊物質和元件中含有條款4條1款所提及物質的最高值;
(b)exempting materials and components of electrical and electronic equipment from Article 4(1) if their elimination or substitution via design changes or materials and components which do not require any of the materials or substances referred to therein is technically or scientifically impracticable, or where the negative environmental, health and/or consumer safety impacts caused by substitution are likely to outweigh the environmental, health and/or consumer safety benefits thereof; (b)電子電氣設備的材料和元件可以背離第4條1款的規定,如果它們的去除或通過設計改變而使用替代品或使用不含有提及的材料或物質的材料或元件在科技上中不可行時,或替代品對環境、健康和/或消費者安全造成的負面影響似乎超過它們對環境、健康和/或消費者安全造成的益處時;
(c)carrying out a review of each exemption in the Annex at least every four years or four years after an item is added to the list with the aim of considering deletion of materials and components of electrical and electronic equipment from the Annex if their elimination or substitution via design changes or materials and components which do not require any of the materials or substances referred to in Article 4(1) is technically or scientifically possible, provided that the negative environmental, health and/or consumer safety impacts caused by substitution do not outweigh the possible environmental, health and/or consumer safety benefits thereof. 2. Before the Annex is amended pursuant to paragraph 1, the Commission shall inter alia consult producers of electrical and electronic equipment, recyclers, treatment operators, environmental organisations and employee and consumer associations. Comments shall be forwarded to the Committee referred to in Article 7(1). The Commission shall provide an account of the information it receives. 2.附件在遵照條款1 修改之前,歐盟委員會將專門與電子電器設備生產者、回收者、垃圾處理者、環保組織和雇員與消費者協會諮詢磋商。磋商結果應遞交給第7條1款提及的委員會。歐盟委員會應考慮其收到的意見。
   
Article 6 第6條
Review 檢討
Before 13 February 2005, the Commission shall review the measures provided for in this Directive to take into account, as necessary, new scientific evidence. 在2005年2月13日之前,歐盟委員會應檢查本指令規定的措施以便必要時考慮新的科學證據。
In particular the Commission shall, by that date, present proposals for including in the scope of this Directive equipment which falls under categories 8 and 9 set out in Annex IA to Directive 2002/96/EC (WEEE). 特別是,歐盟委員會應在該日期之前提交將第2002/96/EC(WEEE )號指令附件IA 所列的第8 和第9類的設備納入本指令範圍的建議。
The Commission shall also study the need to adapt the list of substances of Article 4(1), on the basis of scientific facts and taking the precautionary principle into account, and present proposals to the European Parliament and Council for such adaptations, if appropriate. 委員會也將根據科學事實並考慮預防原則,研究條款4條1款中物質是否需要調整,適當時,可向歐洲議會和理事會提出建議。
Particular attention shall be paid during the review to the impact on the environment and on human health of other hazardous substances and materials used in electrical and electronic equipment. The Commission shall examine the feasibility of replacing such substances and materials and shall present proposals to the European Parliament and to the Council in order to extend the scope of Article 4, as appropriate. 應當特別注意檢查電子電氣設備中使用的其他有害物質和材料對環境和人類健康的影響。歐委會將檢查取代這些物質和材料的可行性,並且在適當的時候,就擴大第4 條的範圍向歐洲議會和理事會提交建議。
   
Article 7 第7 條
Committee 委員會
1.The Commission shall be assisted by the Committee set up by Article 18 of Council Directive 75/442/EEC (註10). 1.歐盟委員會將由根據第75/442/EEC 號指令第18 條成立的委員會協助工作。
2.Where reference is made to this paragraph, Articles 5 and 7 of Decision 1999/468/EC shall apply, having regard to Article 8 thereof. 2.當參考本款時,應適用第1999/468/EC 號決議第5條、第7條以及第8條。
The period provided for in Article 5(6) of Decision 1999/468/ EC shall be set at three months. 第1999/468/EC 號決議第5條6款規定的期間應被設定為3個月。
3. The Committee shall adopt its rules of procedure. 3.委員會將採用其程式規定。
   
Article 8 第8條
Penalties 罰則
Member States shall determine penalties applicable to breaches of the national provisions adopted pursuant to this Directive. The penalties thus provided for shall be effective, proportionate and dissuasive. 成員國對於違反根據本指令制定的成員國規定的行為,應做適當的懲罰。所做的懲罰應具備有效、適度及勸誡性。
   
Article 9 第9條
Transposition 過渡期
1.Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive before 13 August 2004. They shall immediately inform the Commission thereof. 1.成員國應在2004年8月13日之前,使符合本指令所必要的法律、規則和行政規定生效,並將這些立即通知歐委會。
When Member States adopt those measures, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. The methods of making such a reference shall be laid down by the Member States. 當成員國制訂那些措施時,它們必須包括本指令的參照編號或在該國官方出版物上出版時,伴以此參考編號;標示此參考編號的方法由成員國規定。
2.Member States shall communicate to the Commission the text of all laws, regulations and administrative provisions adopted in the field covered by this Directive. 2.成員國要將本指令範圍內制定的所有法律、規則和行政規定的文件通知歐委會。
   
Article 10 第10 條
Entry into force 生效
This Directive shall enter into force on the day of its publication in the Official Journal of the European Union. 本指令自在歐洲共同體《官方公報》上公佈之日起生效。

Applications of lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE) which are exempted from the requirements of Article 4(1); (2005/717/EC) 排除第4條1款中所要求的鉛、汞、鎘、六價鉻、聚溴聯苯(PBB) 或聚溴二苯醚(PBDE) 的應用。(2005/717/EC 修正)
1.Mercury in compact fluorescent lamps not exceeding 5 mg per lamp. 1.小型日光燈中的汞含量,每隻燈管不得超過5毫克;

‧歐洲法院(European Court of Justice, ECJ)於2008年4月初發佈公告,歐盟委員會2005 年公佈的RoHS 指令豁免項目存在程序上的疏忽,因此廢除委員會決議2005/717/EC (RoHS 指令補充決議)第二項第9a條對聚合物中Deca-BDE(十溴二苯醚)的豁免,裁定將於2008 年7 月1 日執行。因此針對Deca-BDE 的豁免只能延續到2008 年6 月30 日。
